A testamentary trust is unique because it is created through a will and only comes into existence upon the grantor’s death. Consequently, unlike revocable living trusts that can be modified during the grantor’s lifetime, testamentary trusts are irrevocable.
They are frequently used to provide for minor children or beneficiaries who may need financial guidance. For example, a parent might establish a testamentary trust to ensure their child’s inheritance is managed responsibly until they reach adulthood. Testamentary trusts can also be helpful in situations where a beneficiary has special needs and requires ongoing care.
Conversely, living trusts are established during the grantor’s lifetime and allow for greater flexibility. They can be amended or revoked as circumstances change.
