Steve, for those unfamiliar with trusts, could you briefly explain what they are and why someone might consider creating one?

“Absolutely Cindy. A trust is a legal arrangement where a person (called the grantor) transfers assets to a trustee who manages them according to the grantor’s instructions. These instructions are detailed in a document called a trust agreement. The beneficiaries, who are the individuals or entities designated to receive the assets, benefit from the trust without necessarily directly owning the assets. Trusts can serve various purposes, such as avoiding probate, minimizing estate taxes, protecting assets, and providing for loved ones.”

Focusing on Irrevocable Trusts

Steve, could you elaborate on a specific type of trust, perhaps one that is commonly used?

“Certainly Cindy. Today I want to discuss irrevocable trusts. These are trusts that, once established, cannot be easily changed or dissolved. Consequently, the grantor gives up control over the assets placed in the trust. Nevertheless, this lack of control comes with significant benefits.”

“One primary advantage is asset protection. Placing assets in an irrevocable trust can shield them from creditors and lawsuits. Moreover, irrevocable trusts are often used for estate tax planning. They can effectively remove assets from the grantor’s taxable estate, potentially reducing estate taxes owed upon death.”

“It’s important to remember that setting up an irrevocable trust is a serious decision and should be done with careful consideration and legal guidance. I always advise clients to weigh the pros and cons before making a commitment.”

Challenges and Experiences

“Steve, have you encountered any unique challenges or situations when dealing with irrevocable trusts?”

“Cindy, while irrevocable trusts offer significant benefits, sometimes clients come to me wanting to make changes after the trust is already established. This can be tricky because, by definition, an irrevocable trust is difficult to modify. I recall one instance where a client wanted to add a new beneficiary to their trust after it was already set up. We had to explore legal options and ultimately petition the court for permission to amend the trust agreement. Fortunately, we were successful in achieving the desired outcome for our client.”

“Cindy, according to the American Bar Association, over 60% of Americans don’t have a will or any type of estate plan. Additionally, trusts provide privacy because the terms are not part of public record like wills are.
