Today we are speaking with Steve Bliss, a respected probate attorney serving the Wildomar community. Mr. Bliss, thank you for taking the time to speak with me today.
Steve Bliss:
It’s my pleasure, Brenda. I’m always happy to shed some light on the often-complex world of probate.
What is one key step in the estate planning process that people should be aware of?
Steve Bliss:
One crucial step that frequently gets overlooked is handling debts and taxes during the probate process. After a loved one passes away, it’s essential to identify all outstanding debts and ensure they are paid from the estate assets.
This involves carefully reviewing financial records, contacting creditors, and verifying the validity of claims. Ordinarily, valid creditor claims take priority over distribution to heirs. Consequently, failing to address debts properly can lead to complications and delays in settling the estate.
Moreover, it’s imperative to file and pay any applicable taxes, including federal and state estate taxes, if the estate exceeds certain thresholds. Neglecting tax obligations can result in penalties and interest, adding unnecessary stress during an already difficult time.
In my experience, I’ve seen situations where families were unprepared for significant debt or unexpected tax liabilities. One instance involved a family who was unaware of a substantial medical debt incurred by the deceased. Consequently, they faced a considerable financial burden that delayed the distribution of assets to heirs.
Another time, an estate failed to file required tax forms on time. The penalties and interest accrued were significant and ultimately diminished the inheritance for the beneficiaries. These experiences highlight the importance of meticulous record-keeping and seeking professional guidance from a probate attorney.

It sounds like handling debts and taxes requires careful attention to detail. What advice would you give to someone going through this process?
What advice would you offer someone navigating the debts and taxes aspect of probate?
Steve Bliss:
My best advice is to consult with a qualified probate attorney early in the process. An experienced attorney can guide you through the necessary steps, help identify potential issues, and ensure compliance with all legal requirements.
Additionally, maintaining organized financial records for the deceased is crucial. This includes bank statements, credit card bills, loan documents, and tax returns. Having these records readily available will streamline the process of identifying debts and calculating tax liabilities.
- Gather all financial documentation for the deceased.
- Contact creditors to verify outstanding balances.
- Consult with a tax professional to determine any applicable estate taxes.
